Gilber Guzman is the artist that created an iconic mural in Santa Fe many years ago. It is called “Multicultural.” The New Mexico Department of Cultural Affairs was to remove the mural in order to build a new art museum. This created no small uproar in a town that tries to preserve its culture. Ms. Quintero took the case, which became a much broader cause in Santa Fe…in a fight against gentrification and for cultural preservation wrapped up in the fight for free access to art. Ms. Quintero filed a federal lawsuit and request for injunction against the New Mexico Department of Cultural Affairs claiming Mr. Guzman retained VARA rights. The Visual Artists Rights Act of 1990 (VARA) protects visual artists' "moral rights" by prohibiting the destruction of "visual art," including paintings, drawings, sculptures or photographs, of "recognized stature." A settlement was ultimately reached with the department which includes a more permanent installment by Mr. Guzman in what will become the new Vladem museum coming 2023.
